Even the capital of Australia has legalized cannabis. When will we?

The Australian Capital Territory has legalized cannabis, regulating possession of up to 50 grams for adults and the cultivation of 2 plants per person or 4 per family. The law will come into force at the end of January 2020, while at the federal level the substance remains illegal, raising several questions about how the situation will be handled.

While in Italy, almost three years after the approval of the law on industrial hemp, politics has not yet managed to regulate the marketing of inflorescences with a low THC content, there is another country that, given the international results of policies that move towards the regulation of cannabis in all its aspects, has decided to legalize cannabis for recreational use. We are talking about Australia, which in recent days approved a law that makes the cultivation and possession of cannabis legal in the capital Canberra. A measure that establishes that adults have the right to possess up to 50 grams of cannabis and to grow 2 plants per person or 4 per family. This is not a law that came out of nowhere, but is the result of a process that lasted years. In fact, it was 2016 when cannabis for medical use was legalized in the country, launching a national debate that led to the decriminalization of cannabis use in several jurisdictions. Australia is in fact a federal state and the law that was recently approved only applies to the territory of the capital, but it is a strong signal. The problem that arises now, as has been the case for years in the United States, is that at the federal level cannabis remains illegal. An aspect that was underlined by Attorney General Gordon Ramsay, explaining that the risk of arrest has not been "completely removed" but that "in practice" the federal laws will be inapplicable.

In this regard, Michael Pettersson, the Labor politician who brought forward the bill, said he was “very confident” that there will be no problems. In fact, the police have already declared that they will coordinate with the government when the new law comes into force, also to understand how to interact at a federal level. In any case, the measure that regulates recreational cannabis will come into force starting January 31, 2020, with amendments that oblige consumers to keep cannabis away from children, prohibit its use in the presence of minors and its cultivation in public spaces.
